"Exposure to Benzene Causes Suits"

Over 29 plaintiffs are currently waiting for their day in court to see justice served for their supposed wrongful exposure to benzene.

While half of the plaintiffs have already died from cancer, several more wait anxiously and attorney Lon Walters estimates it could be another 10 years until the plaintiff's voices are heard.

Exposure in Sugar Creek

In 1904, the Standard Oil Co. opened their first refinery in Sugar Creek.

Beginning in the 1940's, residents began complaining of petroleum fumes and noticed a constant fog that surrounded their town.

In the 1990's Amoco spent millions to try and settle litigation by property owners over damage due to oil spills and the refinery was closed.

Cases in Waiting

Sean Reed is suing the refinery blaming them for his leukemia, which he developed after the oil spills occurred.

However, some, like Jimmie May who learned 10 years ago that he had non-Hodgkin's lymphoma, have yet to see their day in court.

“It's a case of hang on to your money as long as you can,” explains Walters, “ the longer you drag it out is exactly what is happening. People will die.”

Only three cases have reached a conclusion.

One case involved Nancy Ryan who had cancer and died while the trail was still ongoing. Her husband then continued through with the wrongful death suit.

In another, the plaintiff was awarded $13 million in a settlement and BP settled the third for an undisclosed amount.
