"Texas Wife Sues after Losing Husband to Benzene Exposure"

A Texas woman filed a lawsuit against E.I. DuPont De Nemeours and 43 other businesses on behalf of her husband who died from Benzene exposure. Edna Gibson claims that her husband, Weldon Gibson, was wrongfully exposed to benzene during his employment with the chemical company.

Edna filed the benzene lawsuit Aug. 28, seeking compensation for Weldon’s death. The lawsuit claims that Weldon was exposed to toxic and carcinogenic benzene during his employment at DuPont’s Sabine Works Facility in Orange, Texas; however, it does not specify the dates in which he was employed with the company.

Lawsuit Claims the Defendants Knew of Benzene Exposure

The lawsuit claims that despite their knowledge of the dangers of benzene, the 44 defendants still allowed their employees to handle products containing the toxic material on a daily basis. Amco and Lyondell Chemical are among the other companies named in the suit for not warning the public of the dangers of their products.

Wife Seeks Compensation

Edna is suing the 44 companies for her husband’s mental anguish, pain, disfigurement, lost wages and punitive damages. Weldon died of acute myelogenous leukemia Feb. 12, 2008.

Regulations against Benzene Exposure

Due to the harmful effects of benzene exposure, OSHA, the Occupational Safety and Health Administration, has instituted regulations to protect the health of workers who handle the toxin. One of the guidelines states that employers must make sure their employees are not exposed to more than 1 part benzene per million parts of air during one work week.

Companies that fail to follow OSHA’s guidelines are subject to being sued for negligence.
