Benzene Lawsuit Filed against Texas Company

An Arizona man is suing Safety-Kleen Systems, Inc., a Texas-based liquids manufacturer, claiming that he developed a type of leukemia after using some of Safety-Kleen's benzene-filled products.

Brian Foray, who now lives in Arizona, says that he endured massive amounts of benzene exposure during his 17 years of working as a mechanic and maintenance man. According to Foray, his work in both of these occupations called for him to use a degreaser, a solvent and automotive fluid – all produced by Safety-Kleen and all containing toxic benzene.

Two of the benzene-containing products specifically listed in Foray's suit include Raffinate and Liquid Wrench.

Benzene Toxicity

Benzene, a clear liquid derived from crude oil, is commonly an ingredient in plastics, paints, solvents and other synthetic materials. However, while benzene has a variety of useful applications, it is also a highly toxic substance that can cause serious health problems when inhaled or ingested. In the short-term, benzene exposure can result in:

• dizziness
• headaches
• nausea
• tremors
• unconsciousness
• loss of balance and coordination

Over years of exposure, benzene typically causes incurable, possibly fatal conditions, such as:

• anemia
• arrhythmias
• bone marrow disorders
• leukemia
• reproductive problems

Foray and his lawyers are claiming that Safety-Kleen:

• knew about the toxicity of its products
• was negligent in warning its customers about the potential side effects of using their benzene-filled liquids

Along with seeking compensation for Safety-Kleen's negligence, Foray and his benzene attorneys are also hoping to be awarded damages for:

• the cost of Foray's long-term medical care
• the loss of Foray's income, as this plaintiff can no longer work to support himself and his family
• the pain and suffering resulting from Foray's benzene-related leukemia

The ruling and awards for this case are expected to come sometime in early 2009.
