
Benzene News"Motion for Summary Judgment Denied in Benzene Case" August 21, 2008 When a toxic tort suit was filed against various Cooper Tires chemical suppliers, the defendants didn’t think the plaintiff would be able to prove his case. The suit claims the plaintiff was injured due to the presence of benzene in different products he used daily. Despite the assumption of the defendants, an Arkansas judge denied them the motion for summary judgment. Couples Files Benzene Suit Arnold W. Russell and his wife Pamela, filed the suit against Cooper Tires’ chemical suppliers for not warning consumers about the toxic chemicals, like benzene, in their products. While working at the Cooper plant as a tire builder, Russell claims he often used rubber solvent containing benzene. Ashland Inc. and Union Oil Company of California were named as defendants in the lawsuit. Companies Dispute Case The defendants filed for a motion for summary judgment stating that Russell’s claims lacked proper evidence. However, Judge Barnes disagreed with the companies and the case is proceeding. Plaintiff Blames Exposure for Cancer Russell claims in the suit that his exposure to benzene caused the leukemia he is now living with. Since his diagnosis, he has been forced to undergo several rounds of treatment and has suffered mentally, physically and financially.
