"Lawsuit Filed Against Shell Oil"

A lawsuit was recently filed by the Sierra Club and Environment Texas against Shell Oil Co. and several of the company’s affiliates claiming that the company has violated federal air quality standards.

The suit marks the first time in Texas’s history that a suit has been filed involving citizen groups who are attempting to stop illegal air emissions from “unpermitted releases of air pollutants.”

Shell Accused of Violating Clean Air Act

Shell is being accused of repeatedly violating the Clean Air Act at the Deer Park refinery and chemical plant.

According to reports, the violations have resulted in the release of excess air pollutants throughout the past five years, including the release of benzene.

“On average of more than once a week for at least the past five years, Shell has reported that it violated its own permit limits by spewing a wide range of harmful pollutants into the air around the Deer Park plant,” explained Luke Metzger, the executive director of Environment Texas.

Clean Air Act Details

The Clean Air Act has a “citizen suit” provision that enables private citizens who have been harmed by violations of the law to bring enforcement suit in court if regulators don’t take action.

“Because the state of Texas and the U.S. EPA have both failed to put a stop to these blatant violations, ordinary citizens are stepping up to enforce the law themselves,” states the suit.
