The consumer sued the company due to concerns about the amount of benzene in soft drinks produced by Publix. Soda Causes Suit In the suit, the consumer claimed that two ingredients in the Diet Lemon Lime soda, ascorbic acid and potassium benzoate created a harmful amount of benzene when combined and exposed to heat for a long duration of time. Since the suit, the formula for this soda has reportedly been changed to prevent benzene from forming. “Out of an abundance of caution and continued consumer confidence in our brand, we engaged our supplier to reformulate our Diet Lemon Lime variety to prevent the possible formulation of benzene,” claimed Maria Brous, a spokesperson for Publix. Product Recall The cans of Publix Diet Lemon Lime soda with a use by date of July 3, 2008 or later have reportedly been reformulated. Customers who have purchased cans of the problematic soda with this expiration date are encouraged to return the product to the store within the next 90 days for a full refund.
