
Benzene Safety"Neodesha Files Benzene Suit for $423M" November 29, 2007 The city of Neodesha in Kansas, has filed a suit seeking more than $423 million from BP Corp North America Inc., and other related companies in a large pollution trial that is currently underway in Kansas. Neodesha hopes to recover the costs of cleanup caused by an oil refinery that was in operation over 24 years ago in the small town. Small Town Contaminated According to city officials, the suit, which accuses the companies of breach of contract, fraud and holds them liable for the spills, is expected to take several more weeks until a settlement is reached. “The case involves the catastrophic contamination of a small town by the oil giant BP Corp. and its predecessors…We have their promised cleanup for 24 years and finally filed suit, and in discovery realized they had no intention of cleaning it up,” explains John Edgar, the attorney for the city. Lawsuit in Progress The ongoing lawsuit is seeking $279 million for cleanup, $52 million in property claims, and $92 million for lost property values. Reports claim that the contamination of benzene and other harmful chemicals covers about 70 percent of the town. The lawsuit states that the people of Neodesha were lied to by the defendants when they were told that the situation was being taken care of. “They weren’t planning to clean it up at all, they were planning to leave it,” Edgar states.
