"Couple Files Suit for Benzene Exposure"

A previous laboratory operator, pipe fitter and technician has filed a suit against his former employer for his alleged exposure to benzene.

The worker’s exposure to the harmful carcinogen reportedly caused him to contract acute myelogenos leukemia in 2005.

Couple Files Suit

Robert Oakley and his wife, Irene, filed the suit against Air products and Chemicals, Atlantic Richfield Company, BP Corporation North America and the United States Steel Company for unknowingly being exposed to benzene and other toxins during his 51 years of employment.

Oakley transferred between each of these companies and worked at various positions, all of which he claims exposed him to harmful chemicals that eventually led to the disease that he is now forced to live with.

The Allegations

The lawsuit claims the defendants acted with negligence, malice, and failed to warn regarding occupational exposure, putting their employees at risk.

The Oakley’s say they should have received protection under the Hazard Communication Standard and they believe the defendants’ refusal to protect violated the Hazardous Substances Act.

Irene Oakley hopes for damages to be recovered such as loss of society, consortium, companionship and medical expenses.

She also cites that due to his illness she has lost the support and care of her husband.
