"Woman Sues Chevron Over Husbands Benzene-Related Death"

Louise Thibodeaux has recently filed a benzene lawsuit against Chevron USA and Texaco, claiming that her husband developed a fatal condition following workplace benzene exposure.

Joseph Thibodeaux, Louise's husband, worked for Texaco, where, the plaintiff claims, he was exposed to toxic levels of benzene. In 2007, Joseph developed and died from Myelodysplastic Syndrome, a condition marked by abnormal blood cell production.

Also known as "pre-leukemia," Myelodysplastic Syndrome puts patients at a significant risk of developing acute myeloid leukemia (AML), a blood cancer affecting the white blood cells. AML is the most common form of leukemia.

What is Benzene?

Benzene is a colorless, sweetly fragrant liquid that comes from refined oil and coal. Although benzene has a number of useful applications – including as an ingredient in dyes, degreasers, solvents and other synthetics, it is also a highly toxic substance when inhaled or ingested.

Since benzene readily dissolves in air, water and soil, it's likely that those who work with or around benzene will be exposed to this toxin. Gas station employees and refinery workers are among those with the highest risk of experiencing dangerous benzene exposure.

Some of the health complications associated with prolonged benzene exposure include:

• anemia
• immune system suppression
• reproductive disorders
• various types of leukemia

According to filing documents, Louise and her attorney, Keith Hyde, are claiming that Chevron and Texaco:

• knew about rampant benzene exposure in their refineries
• failed to provide workers with adequate training and proper safety equipment
• didn't warn workers about the potential for harmful benzene exposure

Ultimately, the plaintiffs plan on proving that such malicious and negligent behavior resulted in Joseph's fatal disease. While there has been no public announcement of the specific amount of damages the plaintiffs are seeking, they are looking to be awarded a settlement that will exceed the jurisdiction's limits.

This case will likely be settled in the coming year.
