
Benzene Safety"Suit Filed Against Burley Oil Co." November 26, 2007 A couple living in Kentucky recently filed a suit against Burley Oil Co. claiming that the company is exposing them and their property to benzene. Hank Graddy, the attorney for the couple, filed the suit for Terry and Sandi Kerschner last week. Kerschners Take Action The Kerschners are asking the court to prevent Burley from being a “public and private nuisance” on their property. The couple is seeking damages “for loss of market value on their property” and for emotional distress, pain, suffering and annoyance. An investigation reportedly begun on the property four years ago and the problem hasn’t been corrected. “That’s frankly unacceptable,” says Graddy. Lawsuit Claims The state Environmental and Public Protection Cabinet declared the Kerschners property to be an “environmental emergency” in 2005. Amongst the Kerschners claims in the suit, are:
