"Ohio Lawsuit Seeks Reparations for Benzene Exposure"

Over 600 people living in Ohio have filed a class-action lawsuit against the Republic Services of Ohio, as well as the Waste Management of Ohio, for insufficiently protecting them from the toxic odors and emissions produced by the Countrywide Recycling and Disposal Landfill. The landfill is jointly owned by the Republic Services and Waste Management of Ohio.

Filed in mid-October 2008, this lawsuit seeks large-scale compensation for residents of Bolivar, OH who have:

• Been exposed to benzene, a carcinogenic gas, and have had their health thus (or otherwise) impaired

• Experienced property devaluation as a result of the landfill's activities

• Not been able to fully use or enjoy their properties due to the landfill

Evidence Supporting the Residents' Claims
According to records at the Ohio Environmental Protection Agency (OEPA), these residents have been filing complaints about the landfill since 2006. Upon receiving hundreds of these complaints, OEPA deemed the landfill a "public nuisance" and mandated that both the Republic and Waste Management organizations make changes to resolve the landfill's issues.

Additionally, federal EPA agents and top-level health officials have also ordered these organizations to overhaul the landfill so that it's no longer a public nuisance.

However, despite such orders and continued complaints from residents, the landfill continues to emit nauseous, toxic gases that range from being putrid and irritating to toxic and life threatening.

Effects of Benzene
Of all of the landfill's emissions, benzene is one of the most toxic, as it is known to cause serious health problems in those exposed to it for a significant period of time. In the short term, benzene exposure can result in:

• accelerated heart rates
• anemia
• disorientation
• dizziness
• fatigue
• headaches
• nausea
• unconsciousness
• vomiting

Over longer periods of time, benzene exposure causes:

• irreversible damage to the reproductive system
• leukemia
• severe anemia
• death

Because benzene partially dissolves in water and fully evaporates in air, people can experience benzene exposure when they come into contact with contaminated air, water and/or soil.
