Benzene News"Alabama Supreme Court Reverses Past Decision" February 4, 2008 The Alabama Supreme Court recently reversed a past decision that denied justice to individuals who have become ill due to exposure to toxic substances. Under the new ruling, people who become sick from toxic substances will be able to seek justice in courts for any wrongdoing without time constraints. Old Court Ruling The old court ruling gave people who became ill from exposure to benzene and other harmful substances two years to file a suit and seek justice. Therefore, people who didn’t realize they were sick until two years after exposure were unable to receive any compensation. Substances such as benzene and asbestos often don’t show any harmful affects until years after exposure, so the old ruling is believed to have cheated many out of receiving the justice and legal compensation they deserved. The court decided that the 29-year-old ruling was outdated and unfair to those who were wrongfully exposed to toxins without knowledge. Case which Prompted the Decision The court’s ruling was reportedly provoked by the case of Jack Cline. Cline reportedly developed leukemia after being exposed to benzene at Griffin Wheel Co. He didn’t get sick until six years after he quit the job, which under the old rules meant he was out of luck. However, under the new ruling victims like Cline can now seek the justice they deserve.
